Ballots in Senate race head to appeals court

FONDA - The race for the 46th state Senate District will move to an appeals court after the attorney for candidate George Amedore filed an appeal.

Amedore and candidate Cecilia Tkaczyk are battling for votes in the tight race. Courts are determining the validity of several hundred ballots.

In response to a notice of appeal filed at the Montgomery County Clerk's Office Monday, the state Appellate Division issued a temporary order that prevented the ballot envelopes from being opened and counted as previously planned.

Gary Ginsburg, spokesman for Tkaczyk's campaign, said the Appellate Division issued an order to stay acting state Supreme Court Judge Guy Tomlinson's order to start opening ballots today. This means that once the rulings on 40 more ballots left from Ulster County are made, the ballot review will move into the appeals process.
