JOHNSTOWN - A Dolgeville man was found guilty in City Court on Friday of driving while impaired and speeding.
Eric P. Gutowski, 33, of 114 Bellen Corners Road, Dolgeville, was found guilty of driving with an 0.08 percent or more blood-alcohol content, driving while ability impaired and speeding.
According to a news release, the six-person jury deliberated in City Court for 3 and a half hours. Gutowksi was charged Nov. 10 after an officer observed Gutowksi speeding on North Perry Street at 11:06 p.m. A test of Gutowski's blood-alcohol content resulted in a BAC of 0.18 percent. Gutowski has previously been convicted twice of DWAI in 2006 and 2011.
He faces up to one year in jail and a fine of $1,000 when sentenced on Aug. 5 at 9 a.m.
Fulton County Assistant District Attorney Amanda Nellis prosecuted the case. Nellis called three witnesses at the trial, which began Wednesday. The defendant was represented by Johnstown Attorney Michael Viscosi, of the Anelli/Xavier Law Firm.
