PERTH-A Greene County man was arrested this week after a two-month investigation into a Feb. 28 car accident
John W. Firstiun, III, 35, of Hannacroix, Greene County, was charged by state police with one count of second-degree vehicle assault, a felony, two counts of misdemeanor driving while intoxicated and several violations of Vehicle and Traffic Law.
He was charged after test results revealed that his blood-alcohol content was almost twice the legal limit at the time of the accident, state police said in a news release.
David Bubniak, 54, of Broadalbin, and Firstiun were sent to Albany Medical Center after the head-on collision on Route 30, which took place at approximately 10:30 p.m.
State police said Bubniak was driving south on Route 30 and Firstiun was driving north. Firstiun crossed into the southbound lane, colliding with Bubniak, police said. Bubniak suffered from a fractured leg and broken ribs, while Firstiun suffered severe head trauma.
Firstiun is set to appear in Perth Town Court Monday.
