Northville man faces year in jail

December 12, 2013
The Leader Herald

NORTHAMPTON -A Northville man was convicted in Town Court on Tuesday afternoon in an assault case and faces up to a year in Fulton County Jail.

Donald R Town, III, 39, of 221 North Third St., was convicted of misdemeanor third-degree assault, culminating a six-member jury trial before Town Justice John Farquhar.

The office of District Attorney Louise Sira, which prosecuted the case, issued a news release Wednesday indicating the defendant did not testify. The release said the conviction results from an arrest by state police following an April 15 incident at Town's residence in Northville. The release said Town tackled John English - of Edinburg - from behind, forcing him to strike the ground. The victim suffered a broken nose and maxilla, facial lacerations, swelling and bruising, the release said.

A previously issued Order of Protection in favor of the victim remains in effect.

Town faces up to a year in jail and/or $1,000 fine when he is sentenced at 3 p.m. Feb. 13.

Assistant District Attorney Amanda Nellis prosecuted the case.

The defendant was represented by Gloversville Attorney Michael W. Albanese.
