Police: Man refused to leave store

GLOVERSVILLE - A man who previously was charged with murder was arrested Wednesday after he had an open container in a convenience store and refused to leave, police said.

Derek A. Kenney, 43, of 157 Handy Road, Mayfield, was arrested by city police and charged with violations of open container and trespassing.

Police said Kenney was arrested at 198 S. Main St., Country Farms, where he was found to be intoxicated and in possession of an open container of beer. He had been told by the owner, Gary D. Patel, to leave several times, police said.

He was held for arraignment and sent to the Fulton County Correctional Facility.

Kenney previously was charged in the death of Johnstown resident Brian Morrison, but the charges later were dismissed.
