GLOVERSVILLE - A Mayfield man previously accused of killing a Johnstown resident was charged Wednesday on an open-container violation.
Derek A. Kenney, 42, of 157 Handy Road, Mayfield, was charged at 9:30 p.m. at 34 S. Main St., the Kingsboro apartments address, city police said.
While investigating a disorderly conduct complaint at the city address, police said, Kenney was found with an open Busch Light beer can.
Kenney was issued an appearance ticket and released, police said.
In July 2010, Kenney was charged with second-degree murder after police said he fatally stabbed Brian Morrison on Bleecker Street.
The charges later were dismissed after Kenney's attorneys argued grand-jury proceedings against Kenney were tainted because witnesses lied.
No one else has been charged in the stabbing death.
