JOHNSTOWN -A former employee of the Wells Nursing Home is suing the facility in a federal case, alleging violation of the Family and Medical Leave Act of 1993, a civil rights violation, and requesting unspecified damages.
Cynthia Skonieczny of Oppenheim filed a civil lawsuit Monday in U.S. District Court in Utica.
She was employed for 10 years at the nursing home as a full-time, certified nursing assistant until her termination June 15. The suit says Skonieczny had gone out of work in April, being approved for leave through the federal Family and Medical Leave Act because of a "serious health condition" to a knee. She returned to work two weeks later.
The suit says Skonieczny on June 4 notified the nursing home she required leave again for a serious gall bladder problem, and was hospitalized from June 7-9. She was approved for two weeks leave June 12. But the suit says she was terminated three days later for "failing to call and failing to report to work."
Wells Nursing Home Administrator Neal E. VanSlyke didn't return a phone call Friday seeking comment.
