JOHNSTOWN -A city man who police said broke into a home and stole various entertainment items was sentenced Monday in Fulton County Court to one to three years in state prison.
Michael L. Hilts, 26, of 34 Cayadutta St., was sentenced by Judge Richard C. Giardino to the state prison time. He also must make $300 in restitution to the victim.
The sentence was based on the defendant's April 3 guilty plea to one count of third-degree burglary, as part of a plea arrangement.
Hilts was charged by city police Feb. 28 with third-degree burglary, criminal mischief and petit larceny. Police said he broke into a home on School Street and stole entertainment items such as video games, an X-box video-game system and a flat-screen TV.
In another County Court case Monday:
Harry Western, 52, of Route 119, Ephratah, pleaded guilty before Giardino to one count of aggravated driving while intoxicated.
Sentencing was adjourned until Aug. 16, but under the terms of a plea arrangement, he is slated to receive five years of probation, a mandatory ignition interlock device for his vehicle, an 18-month driver's license suspension and a $1,000 fine.
Western was charged by state police Dec. 1 with aggravated DWI because he had children in his vehicle. He also was charged with DWI, driving with an 0.08 percent or greater blood-alcohol content and speeding.
