Fonda man faces felony DWI charge

FONDA - A village man is facing a felony charge of driving while intoxicated after state police said he had a blood-alcohol content twice the legal limit when his vehicle was stopped on Route 5 early Sunday.

Nelson D. VanAvery, 38, was arrested at 1:25 a.m. Sunday and charged with DWI, aggravated DWI, failure to keep right, crossing a road- hazard marking and an improper-lane infraction.

The aggravated DWI charge, a felony, was lodged because VanAvery had a 0.08 percent blood-alcohol content when he was tested, state police said.

VanAvery was released on an appearance ticket.
