Lawsuit claiming payment owed for work

FONDA - A subcontractor involved in the construction of Beech-Nut Nutrition Corp.'s headquarters in the town of Florida has filed suit in state Supreme Court to recover more than $100,000 in back payment for services.

D.J. Rosetti Inc. of Malta, Saratoga County, is suing Smyrna, Ga.-based Facility Group Inc., the contractors in the construction of the Beech-Nut facility in the town of Florida. The suit asks for $101,049, the difference between the $3.96 million agreed-to price and the $3.86 million paid so far, according to the documentation. Rosetti sent Facility Group monthly invoices showing the balance owed, but Facility Group never finished paying, according to the suit.

Beech-Nut opened its new headquarters in June 2010.

In December 2008, Rosetti signed a $3.63 million contract to provide labor and materials for a concrete slab for the building, according to the lawsuit. Additional labor and materials, valued at $327,111, pushed the total cost to $3.96 million, according to the suit. Facility Group has paid Rosetti $3.86 million, leaving the balance of $101,049, according to the suit.

The lawsuit demands payment of $101,049, along with interest accrued since July 14, 2011 and court costs and disbursements.
