Machines malfunction at several polling sites
By MICHAEL ANICH, The Leader-HeraldJOHNSTOWN - Malfunctions with new voting machines in five of Fulton County's towns caused by a server problem and human error, coupled with a civil action in Essex County affecting results from the 23rd Congressional District, mean no results are available yet from those towns for Tuesday's general election.
Democratic Deputy Board of Elections Commissioner Linda Coons said today the results on paper ballots from the five towns are in a locked room because machines were impounded. She said election officials cannot access those results - how many people voted and who they voted for - until the impound has been lifted.
Republican Deputy Board of Elections Commissioner Linda Madison informed the media and the public Tuesday night at the board's office on Route 29 that there was a computer-related problem that affected the towns of Bleecker, Broadalbin, Northampton, Oppenheim and part of Perth. She said new voting machines designed and programmed by the Sequoia-Dominion Co., which has a regional office in Rochester, had scanners that froze due to a programming glitch.
The software problem involving memory cards for the new machines affected results from the five towns in question, Madison said.
Elections officials said the problem resulted in a message of only "casting ballot" when ballots were scanned.
Democratic Election Commissioner John Schermerhorn said a show order cause legal action also was filed this week by Essex County Democratic Chairwoman Sue Montgomery-Corey in state Supreme Court in that county. That action was against various boards of elections in the counties of the 23rd Congressional District and the three candidates running for that seat - Democrat William L. Owens, Republican Dede Scozzafava and Conservative Douglas L. Hoffman.
Madison said the petition was signed by Supreme Court Justice Robert J. Muller that impounded all voting machines that malfunctioned in the district.
The Leader-Herald received a copy of the legal action, which stated in part: "The petition is made due to the fact that Essex, Clinton and Oneida counties utilize level voting machines, which cannot accommodate the different registration cut-off dates for general and special elections. As such, these machines cannot have multiple ballots and there is no way to mechanically restrict the offices a voter may cast a vote for.
"Therefore, those voters who are eligible only to vote in the special election for representative in Congress will have to vote by paper ballot," the petition said.

i say there should be a re-vote. bring up a machine that works to the places that they didn't work and have another voting day. it even states in the article that there is a memory problem... and how can they say 100% of the votes are in (on tv) and how do they know who won already when 5 places are even counted yet? REVOTE!!!!

It seems over the last 40 years or so the people have been dumbed down sufficiently enough that we "need" new voting machines because people are too simple to be able to even cast a ballot? I guess we also "need" antilock brakes on cars so those with the "right" rather than the "privilage" to drive don't really have to learn to drive at all. Airbags are for the safety of those who never seem to ever get it right. So I guess I'm not surprised that the only thing we have to give up is the secret ballot in order to prevent the "hanging chad". I'll also not be too surprised if we put up with the loss of the right to vote altogether to avoid the the whole*******bother of counting the ballots by hand when the wonders of modern science screws up the electoral process completely...... Do you sense somebody's nearing their objective? (no specific party implied)

We were handed the ballot and told to wait in a line where one could clearly see those who were voting at the "open-style voter booth", as well as those who had already voted and were wating in another line to place their ballots into the machine. There was no "privacy sleeve" handed out and the lines to vote, "open-style voter booth", and the line to place the ballot into the machine were all next to each other. When handed the ballot we were told to fill in the little box fully, not to leave any white space or to go outsdide of the little box. Also told to be careful and not make any marks anywhere on the ballot and to not drop the marker either as that could also make marks. Any of these would cause the ballot to become invalid. And yes, the machine was not working so we were told to simply drop the ballots into the "box" and they would be hand counted.
