Jury denies request in Bleecker matter

POSTED: June 30, 2009

BLEECKER - A jury of landowners has decided a property owner should not be allowed to have a 50-foot right-of-way through property owned by neighboring landowners.

A12-member jury denied Ronald Stergas's request for a 50-foot right of way through a neighbor's property on a private section of Goat Farm Road, deciding the request was excessive.

"The 50-foot-wide private road was not necessary to access the subject's property," Gloversville lawyer Jeremiah Wood said. "Our position was there would be other alternates available, but the matter before this jury was whether this 50-foot road was necessary."

Before the case, the jury visited the property to examine it.

Stergas declined to comment on the matter. If he chooses to appeal, the dispute would go to County Court.
