Two county lawsuits dismissed by sheriff

ALBANY — A lawsuit filed by a Fulton County resident who alleged he was assaulted and “irreparably injured” while in custody in Montgomery County has been discontinued with prejudice.

The suit, filed by Jose Samuels against Montgomery County Sheriff Michael Amato; Jail Administrator Michael Franko; Corrections Officer Terry Carter and John Doe number one, who is said to be a corrections officer, was dismissed on Nov. 6. Settlement conferences had been held in the previous weeks.

This was the second lawsuit against the county that the sheriff dismissed from court this fall.

On Oct. 7, a suit brought on behalf of Ryan Cook was discontinued. Settlement conferences had been held in the weeks prior to the dismissal in that case as well.
